# Commercial and Licence Terms

These Commercial and Licence Terms explain how paid access to **mCommerce365** is typically offered by **ICI Tech Teknoloji A.Ş.**. They form part of our [Terms of Use](https://mcommerce365.com/en/terms/) for the marketing website and are **supplemented or replaced** by the signed commercial agreement for your organisation.

mCommerce365 is a B2B mobile field sales application for Microsoft Dynamics 365 Business Central. It is **not** a consumer app store product and is **not** billed through the Apple App Store, Google Play, or RevenueCat.

## 1. How Purchasing Works

Access is provided under a **commercial licence / subscription** agreed with ICI Tech Teknoloji A.Ş. (or an authorised partner). Pricing depends on user count, scope, and deployment. There is **no public self-serve checkout** on the Site; contact [app@icitech.com.tr](mailto:app@icitech.com.tr) for a quote.

## 2. What Is Included

Paid plans typically include licensed use of the mCommerce365 application for authorised users, Dynamics 365 Business Central integration as described in your agreement, and related support as specified in the order form or statement of work. Feature packs and service levels are defined in the commercial documents—not solely on the marketing Site.

## 3. Billing

Billing is by invoice and/or agreed payment methods under the commercial agreement (for example bank transfer or card payment to ICI Tech Teknoloji A.Ş.’s payment provider). **ICI Tech Teknoloji A.Ş. does not process payment card transactions on the marketing website.** Card details, if used, are handled by the payment provider under its terms. We do not store raw card data on our marketing systems.

## 4. Term, Renewal, and Cancellation

Subscription term, renewal, notice periods, and cancellation rights are set in your commercial agreement. Cancel according to that agreement or by contacting app@icitech.com.tr. Unless required by mandatory law or your contract, unused periods are not refunded on a pro-rata basis.

## 5. Trials and Evaluations

Any trial or proof-of-concept is offered only if expressly agreed in writing and is limited to the scope and duration stated. Trials do not automatically convert to paid subscriptions without confirmation.

## 6. Consumer Withdrawal (If Applicable)

mCommerce365 is designed for **business customers**. If, exceptionally, mandatory consumer law applies (EEA/UK), statutory withdrawal rights may exist under applicable distance-selling rules (including, where relevant, a 14-day withdrawal period). French consumers may benefit from the **Code de la consommation** and **droit de rétractation**; German consumers from **§ 312g BGB** and **§ 355 BGB**; Spanish consumers from **TRLGDCU**. Contact app@icitech.com.tr within the applicable period. B2B contracts may lawfully exclude certain consumer rights where permitted.

## 7. Customer Responsibilities

You are responsible for lawful use of the software, configuring Dynamics 365 access, securing user credentials, and complying with Microsoft licensing for Business Central. You must not use the software for unlawful purposes.

## 8. Privacy and Data

Website enquiry data is covered by our [Privacy Policy](https://mcommerce365.com/en/privacy/). Processing of personal data in a deployed mCommerce365 environment is governed by your commercial agreement and applicable data-protection law. Your organisation typically remains controller of its business and employee data.

## 9. Governing Law

Unless your signed agreement states otherwise, these terms are governed by the laws of the Republic of Türkiye, without prejudice to mandatory local protections for EEA/UK customers.
